Prairieheart Health Guarantee

We guarantee the health of our babies. Our health guarantee is part of our KITTEN contract, not ADULT sales. (See below).

SELLER OBLIGATIONS

Prairieheart Cattery (SELLER) provides the following guarantees:

All references to CAT applies to the Plural of all Cats being sold under this Contract.

  1. Initial Health Condition

  1. The purchased cat, “CAT” was in good health at the time of sale.

  2. CAT will be released only in good health, free of feline leukemia virus (FeLV), feline infectious peritonitis (FIP), and feline immunodeficiency virus (FIV).

  3. CAT will be released only after two kitten vaccinations, deworming, and two or more veterinary examinations.

  4. At no time is SELLER responsible for any Veterinary bills of any kind. The SELLER highly recommends Pet Insurance and failure to continue with insurance is at the BUYER’s own discretion.

  1. Limited 7-DAY Warranty

  1. WARRANTY PERIOD will be 7 days, starting when CAT leaves our primary care and changed hands, either to BUYER or to the shipping service.

  2. If during WARRANTY PERIOD, a board-licenced veterinarian finds CAT to have a life-threatening illness, it may be returned to SELLER for a full refund of original purchase price only.  Warranty is void if cat was in contact with any other Feline during this period. All new cats should be placed in quarantine to ensure no signs of illness present before integration. WARRANTY does not cover cat “colds” or any other stress induced illness as that is not preventable by SELLER.

  1. Limited 2-year Health Guarantee

  1. If CAT dies within 2 years of the date of purchase due to congenital or hereditary defect, documentation must be provided by Veterinarian to prove death was due to defect. Necropsy may be requested by SELLER in order to replace CAT. SELLER will replace CAT within 18 months.BUYER must pay cost of spay/neuter prior to kitten leaving SELLER’s residence. SELLER reserves the right to substitute with a refund. Warranty extended to 4 years of age in the case of death due to HCM, as long as the SELLER is still breeding. Warranty for HCM will only be given if documented by Veterinarian either by HCM heart scan or necropsy.

  2. Veterinary Proof

  3. In order to qualify for any refund or replacement, BUYER must provide an original signed letter from the diagnosing licensed veterinarian, printed on the vet’s stationary, describing the illness and what testing was done to determine so.  In the case of death, an autopsy report must be provided.

  4. SELLER may choose, at their cost, to verify any veterinary claims with their own choice of vet before any refunds/replacements are issued.

  5. Void Warranties

  1. All Warranties and Health Guarantees will be immediately void if any of the following occur:

  1. CAT is exposed to another cat/kitten during WARRANTY PERIOD.

  2. CAT is euthanized prior to notification of SELLER or without SELLER’S knowledge, except in the case where a licensed veterinarian recommends such action as a means of preventing suffering with no other reasonable means of recovering CAT’s health.  In this event, a signed letter from the vet indicating such recommendation will be required to substantiate this claim and must be provided to SELLER within 24 hours. This does not apply for FIP as there is treatment available via FIP Warrior's support groups on Facebook. 

  3. CAT is injured, lost, becomes ill, or dies as a result of being outdoors or during shipping. We prefer that you come in person to pick up the CAT or use a professional Courier company with insurance.

  4. CAT should be vaccinated for rhinotracheitis, calicivirus, panleukopenia, chlamydiosis, rabies and Feline Leukemia. CAT is not vaccinated for feline infectious peritonitis (FIP), feline immunodeficiency virus (FIV), or ringworm. Please do NOT vaccinate for these illnesses!

  5. SELLER does not warranty CAT against any adverse reactions to future vaccinations.

  6. Contract will be void if cat is declawed at any time. Contract is void if cat is allowed outdoors in any manner that is not being carried in a pet carrier.

  1. Breeding

  1. Breeding Rights are not included. Kitten/cat will already be spayed or neutered prior to leaving our Cattery. All kittens will leave with a registration form for TICA.

  2. Buyer Obligations

       BUYER understands and agrees to abide by all the following statements:

       First things first

  1. BUYER will have CAT examined by a board-licenced veterinarian within 7 days of arriving to their home and before contact with any other feline in the home. Also at any sign of illness. BUYER agrees to notify SELLER within 24 hours of any adverse findings by qualified Veterinarian.

  2. Choosing not to take CAT to the vet within 7 days of purchase will void all warranties.

  1. Lifetime care

  1. BUYER accepts the responsibility of caring for the CAT and will provide properly for it’s welfare, which means a life-long commitment of love, appreciation, and responsible care in an indoor environment.  CAT will be kept in a clean environment, with adequate human companionship and space for exercise.

  2. CAT will not be caged as a primary living arrangement, and will be fed high-quality nutritious food daily, keeping them well nourished.  Water will be available at all times, and fresh water will be provided daily.

  3. CAT will be given regular veterinary examinations, and vaccination/health records will be maintained.

  4. CAT will be protected from cold air temperatures both indoors and outdoors. Adequate heating and warm, clean bedding will be provided. Health warranty becomes void if kitten goes outdoors except in a carrier to go to vet for examination. Warranty void if kitten comes into contact with another cat or dog which is not properly vaccinated or if individuals from such a home containing an unvaccinated animal come into contact with CAT.  Seller has right to request proof of immunized state of other felines in household.

  5. CAT will have access to well-maintained litter boxes which will be kept in a location distant from feeding area but not exclusive to a part of the home that is not regularly attended to, such as a furnace room or basement.

  6. CAT’s environment will be free from plants that are toxic to cats and from toxic chemicals. Buyer will educate themselves on what plants and foods are toxic to cats. Please research and use aerosols, candles, or scented oils/diffusers at your own risk. It is highly documented that pets can die from the use of these as they are generally toxic.

  7. BUYER agrees to correspond with SELLER at least once per year on the health and well-being of the CAT and to send at least one photo.

  1. Transfer of Ownership

  1. CAT will never be sold, leased, or given to any pet shop, animal shelter, research lab, or similar facility. CAT will never be abandoned.

  2. If for any reasons, BUYER is not able to keep CAT, SELLER will be considered first to take back CAT with no refund given. In the case that the Cat is rehomed due to unforeseen circumstances and with the knowledge and consent of Seller, Seller is under no obligation to honor warranty for Cat as Cat’s best interest is to be rehomed back to Seller. If SELLER is not able to pick up cat in person, a new screened home may be found for the BUYER by the SELLER as quickly as possible.

  1. Acknowledgements

  2. After WARRANTY PERIOD is over, SELLER will not be held accountable for future diagnosis of FeLV, FIV, FIP, urinary problems, minor upper respiratory issues, minor skin conditions, or any other bacterial or viral infectious disease, including allergy-based, parasites, or fungus due to the fact that these can be contracted anywhere in the environment after leaving the Cattery. All cats within SELLER’S breeding program are negative for these diseases or conditions to the best of their knowledge and any preexisting conditions would have been fully disclosed prior to pick-up.

  3. Grooming

  4. BUYER agrees to provide CAT with adequate ear and eye cleaning as required.

  5. BUYER is aware that flea and tick topical medications may be detrimental to CAT’s health, and agrees not to use them unless directed to and under the supervision of a veterinarian.

  6. Legal Action

  7. BUYER agrees to consult first with SELLER about any issues, including legal action, and attempt to gain resolution first. At no point will public defamation in any form of SELLER or CATTERY be allowed, and in such case, voids ALL warranties and refunds. Any attempt to publicly defame SELLER can result in a fine of $5000. 

  8. Any legal action which may arise under the terms of this contract will be brought in Canada, in the city SELLER currently resides in at the time of dispute.

  9. BUYER shall be liable for any court costs and related charges including attorney’s fees associated with SELLER enforcing the terms of this contract.
